Federal Court orders Apple & HTC to Settlement Talks on 8/28/12

Thanks to Joey for the heads-up...  this morning, a Delaware based Federal Court has ordered Apple & HTC to settlement talks on August 28, 2012. Hang tight everyone, this could be a bumpy news day.

Today the United States District for the District of Delaware ordered the lawyers as well unspecified decision makers of Apple and HTC to meet in Delaware on August 28, 2012, to discuss a possible settlement. The talks will be moderated by Magistrate Judge Sherry R. Fallon.

I don't expect any major developments between now and the date set for this mediation effort that will put the necessary pressure on HTC to settle. HTC doesn't have to fear any major legal breakthrough for Apple (not counting preliminary rulings) for at least the remainder of this year, and it now has bigger problems than this litigation.

If the Delaware court really wanted to make a contribution to a near-term settlement, it should un-stay all those lawsuits except for those claims that are still pending at the ITC. Even if the court did that, the matter wouldn't be ripe for settlement by the summer, but then a mediation effort might succeed in early 2013.

What's this mean for the near-term? Well none of us know what exactly went on in court this morning, and no one is reporting on the elephant in the room - but I do know that we have some sort of movement on the devices sitting in the warehouse - so as soon as I can confirm something in stone, it'll be here.

  3. I think this is about the war and not this battle. All HTC had to do was prove they removed the code that the ITC claimed was infringing. This deals with additional patents beyond the one that the ITC order covered.

    So the 23rd is still the unofficial release date of the Evo 4G LTE?

    Because if we gotta wait until they settle this dispute...I'm gonna be pissed.

  7. good grief ... this couldn't mean that the phones would be delayed until then, right? Those of us that pre-ordered would surely be entitled to a refund and reinstitution of our upgrade discount is there's a 3 month delay ... I'd hope?

  8. Unless there's another court date tomorrow or if CBP needs to complete some sort of investigation, I'm hopeful the phones will start shipping ASAP (today or tomorrow).

  12. I think everyone is wondering the same thing....

    I'm hoping that this is just something HTC has to settle on their own between Apple and it doesn't specifically deal with our devices.

    They just need to reach a settlement by the listed date... That's what I'm hoping for, at least.

If in some unlikely event the phones are not released until the august court date, I'll get my preorder refund (assuming Sprint doesn't want to play with credit card chargebacks), grab a bowl of popcorn, and watch the shitshow between HTC and Apple unfold. Any you know there will be a shitshow if Apple ends up decimating the major launch of a phone in the US.

My rational side sees the end of the post where it is said that there is some sort of movement in the warehouse, but the panicy desperate customer is freaking out. lol I have been keeping a level head and keeping a few friends and family members calm as well, reassuring them that this will be resolved as quickly as possible, but this update scares me just enough to worry.

  17. I like how this guy just copies what our guy here at Inside Sprint Now says, rewords it/takes it out of context, and then posts it on his own blog/forum for his own sake. I understand helping to pass along the message, but rather than rewording it, why not just reference the source so they can read it in it's original format and wording?

  23. He did. I guess what I was trying to get at is, just because ISN puts up a post claiming a "Mole Hunt" has begun, doesn't mean that another blogger should come around and start referring to the guy at ISN as a definitive "Mole".

    Personally, I'm grateful for the work that you do on this blog, (should we just refer to you as Neo from now on). So to me, someone putting that work under a dark light rather than one that conveys the appreciativeness we all feel, is dumb. So fame or not, I'll keep coming back because I feel you're doing the right thing and have an actual mind for customer service.

  26. I would be the guy in question mesanic and I would be glad to have that discussion because I did not reword what he said at all. I am doing no different than any other blog by sourcing this guys and sending people here. His long automatically post link backs ideally my readers want to here what he has to say so they are coming here and becoming readers of this blog. I'm not sure you understand how blogging works but what I have done with his material is source him instead of taking his info and reposting it without sourcing which he will tell you a lot of people are doing. The information is relevant to the people who read are blog and though I don't have access to his analytics mine says I've have sent a bunch of people right here. You are entitled to your opinion but I'm sure you read the android central or the verge they do the same thing with OUR articles sometimes without properly sourcing us. As far as the mole comment goes it really comes from the ongoing discussion we are having with the author of this blogs over in my thread on xda and was clearly meant in jest just as he uses it. He knows exactly who we are he can tell us if he has a problem with us refering our readers to his blog what include the basic gist of the story and link back which is what we should be doing. We are also not in it for fame.

  27. I preordered on BestBuy.com the day it was possible to preorder, and I still haven't received an email about a shipping date. Am I alone? Just thought I'd throw it out there, since the Best Buy email with a shipping date of the 23rd is making the news...Based on info from here, it sure seems like it will ship out much before the 23rd. I hope. Maybe. Grasping at straws...

  30. Any word dealing with the wirefly shipments. I pre ordered from then when you could get the phone for 119.99... Then I heard they couldn't fill all the pre orders they allowed. I checked and they are still selling pre orders now for 139.99... Any news would be helpful thanks

  32. I preordered through Sprint, but I'm still going to run around to all the local Radio Shacks, Best Buys and non-corporate Sprint stores in my area tomorrow morning and see if I can snag one. I'm hoping some phones made it through and at least one of those local stores didn't get the memo to not sell them!

  34. Checked in at Radio Shack that I preordered from at around 5pm today, they confirmed that the phones were held at customs but said it was a labeling issue. She also told me that they would now be $25 less than previously priced at $199....... don't care, just want my phone
